By filling out forms on the TB Hydro website, using the contact form, or simply contacting us directly via email, phone, our profiles on social networking sites, as well as mobile applications of these sites, you provide us with your personal data, and we undertake that your data will remain confidential, secure and will not be shared with any third parties without your explicit consent.

We use analytical tools from companies such as Google, Cloudflare, Vercel, which collect anonymous information about your website visits, such as subpages you viewed, time spent on the page, or transitions between individual subpages. This involves the use of cookies from these companies. You may refuse consent to the above. In that case, you will not be able to contact us through our website.

How and why we process your personal data

We process data of each website user that characterize how they use our website (these are so-called operational data). This processing includes the automatic reading of a unique identifier identifying the end of the telecommunications network or IT system you are using (i.e., your IP address), as well as the server date and time, technical parameters of the software and device you are using (e.g., whether you are browsing our website on a laptop or a phone), and the location from which you connect to our server. This information may be used by us for market research and to improve website performance. Data recorded in server logs are not associated with specific website users. Server logs are only auxiliary material used for website administration.

The legal basis for operational data processing is Article 6(1)(f) of the GDPR (processing is necessary for the purposes of the legitimate interests pursued by the administrator). This legitimate interest is enabling error diagnosis on the website and improving its quality.

The information collected by this tool is completely anonymous and does not allow you to be identified. For this purpose, cookies from Google LLC regarding the Google Analytics service are used. The use of Google Analytics services involves implementing a tracking code provided by Google in the code of our website. This code is based on cookies, but may also use other tracking technologies. Additionally, to contact us, we use Cloudflare Turnstile services, which protect our website from spam bots.

What personal data we process

We always strive to process only the personal data that is necessary and to a minimum extent, while we may process the following personal data of yours: IP address, server date and time, end-device location from which the user connects to the website, technical parameters of the device and software used by the user, device interface language, UTM tags, which specify from which network location the user arrived, online identifiers, including cookie identifiers, internet protocol addresses, and device identifiers (for the use of cookies).

Who we disclose your personal data to

We entrust the processing of personal data to the following entities:

  • OVH Sp. z o.o. – for the purpose of storing data on the server. Our website is located on these servers, everything you enter in our forms must appear there. Your data is stored on secure servers in the European Union. The connections we use to connect to the server are encrypted.
  • Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland – for the purpose of storing data on the server and operating the mail server. We use Google services to handle our email correspondence and store data in the cloud (Gsuite), as well as for analytical and statistical purposes (Google Analytics).
  • Cloudflare Inc. 101 Townsend St., San Francisco, CA 94107 – for the purpose of operating the contact form and protecting our website from DDoS attacks.

Some of the operations described above involve the transfer of your personal data to so-called third countries (outside the European Economic Area), where the GDPR does not apply. However, this always happens based on the legal instruments provided for in the GDPR, guaranteeing adequate protection of your rights and freedoms. Detailed information in this regard can be found in the privacy policies posted by providers on their websites.

How long we will process your personal data

We will process your personal data (operational) for 60 months. The data we collect from you is stored in an anonymized form.

How we enable you to exercise your rights

We make every effort to ensure that you are satisfied with your cooperation with us. However, please remember that you have many rights that allow you to influence how we process your personal data, and in some cases, to stop such processing. These rights are:

  • right of access to personal data (regulated in Article 15 of the GDPR)

Right of access by the data subject

1. The data subject shall have the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and the following information:

a) the purposes of the processing;

b) the categories of personal data concerned;

c) the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;

d) where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;

e) the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing;

f) the right to lodge a complaint with a supervisory authority;

g) where the personal data are not collected from the data subject, any available information as to their source;

h) the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

2. Where personal data are transferred to a third country or to an international organisation, the data subject shall have the right to be informed of the appropriate safeguards pursuant to Article 46 relating to the transfer.

3. The controller shall provide a copy of the personal data undergoing processing. For any further copies requested by the data subject, the controller may charge a reasonable fee based on administrative costs. Where the data subject makes the request by electronic means, and unless otherwise requested by the data subject, the information shall be provided in a commonly used electronic form.

4. The right to obtain a copy referred to in paragraph 3 shall not adversely affect the rights and freedoms of others.
